वक्फ भूमि पर क्रिश्चियन कम्युनिटी का केरला स्टेट वक्फ बोर्ड से कानूनी जंग:

वक्फ टूडे : केरल, एर्नाकुलम जिले में कोच्चि से 38 किलोमीटर दूर अरब सागर के किनारे स्थित गांव में 610 परिवारों का आबादी रहता है जिसमें 510 इसाई, 100 परिवार हिंदू लोग मुनबंम प्रॉपर्टी नाम से मशहूर 404 एकड़ जमीन के लिए करीब 60 सालों से कानूनी लड़ाई लड़ रहे हैं , वहा के लोगों के मुताबिक उन्होंने फारुक कॉलेज मैनेजमेंट से यह जमीन खरीदी थी। केरल हाई कोर्ट के आदेश पर 2019 में वक्फ बोर्ड ने उनकी जमीन वक्फ संपत्ति के तौर पर रजिस्टर कर ली। अब बोर्ड सरकार से लोगों का बेदखल करने की मांग कर रहा है गौरतलब है कि 2 साल से वक्फ बोर्ड के खिलाफ मुनंबम में विरोध प्रदर्शन जारी है । बीते 2 महीने के दौरान विवाद तेज हो गया है वजह यह है कि केंद्र सरकार का वक्फ अमेंडमेंट बिल 2024 आने से लोगों में सरगर्मियां तेज हो गई है । लोगों का मानना है कि यह बिल संसद में पास हो जाए इसके लिए मुनबम के लोग चर्च में प्रार्थना सभाएं कर रहे हैं उनका कहना है कि मौजूदा वक्फ कानून के चलते कोर्ट मे दावे को चुनौती नहीं दे पा रहे हैं।
नया बिल लागू होने पर वक्फ उनकी जमीन पर कब्जा नहीं कर पाएगा दरअसल हकीकत यह है कि यह जमीन मुस्लिम दंपति मोहम्मद सिद्दीकी सैत ने 1950 में फारूक मैनेजमेंट कॉलेज को 407 एकड़ जमींन डेडीकेटेड वक्फ किया था।
वक्फ वेलफेयर फोरम, चेयरमैन ने बिल का विरोध करने की वजह ऐसे मामलों की पहली वजह मानते हैं। और उनका कहना है कि वक्फ अमेंडमेंट बिल 2024 के पास होने से वक्फ संपत्तियों का नुकसान का अंदाजा लगाया जा सकता है।
एक नजर घटना कम पर
1950
मोहम्मद सिद्दीकी सैत ने फारूक कॉलेज को मुनम्बम प्रॉपर्टी दान दे दी। वहां पहले से कई मछुआरे परिवार रह रहे थे।
1962
मछुआरों ने कॉलेज मैनेजमेंट को जमीन देने के विरोध में परवूर सब-कोर्ट में मामला दायर किया। मामला केरल हाईकोर्ट गया।
1975
हाईकोर्ट ने कॉलेज को ही जमीन का असली मालिक करार दिया।
1983
से 1993 के बीच फारूक कॉलेज ने मुनम्बम के लोगों को जमीन बेच दी।
दूसरी बार
2008
केरल वक्फ बोर्ड ने कॉलेज मैनेजमेंट के जमीन बेचने के अधिकार पर सवाल उठाए। तत्कालीन CM वीएस अच्युतानंदन ने जांच कमीशन गठित की।
2009
कमीशन ने रिपोर्ट में बताया कि फारूक कॉलेज ने अवैध तरीके से वक्फ की जमीन बेची।
2010
हाईकोर्ट की डिवीजन बेंच ने राज्य सरकार को कार्रवाई करने का आदेश दिया। वक्फ बोर्ड ने लोगों को बेदखल करने की मांग की।
2019
केरल वक्फ बोर्ड ने मुनम्बम प्रॉपर्टी को वक्फ संपत्ति के तौर पर रजिस्टर कर लिया।
कॉलेज मैनेजमेंट ने वक्फ ट्रिब्यूनल में मुनम्बम प्रॉपर्टी को वक्फ संपत्ति के रूप में रजिस्टर करने को चुनौती दी।
2023
कॉलेज मैनेजमेंट ने कहा कि सिद्दीकी सैत ने उसे मुनम्बम प्रॉपर्टी वक्फ नहीं, एक गिफ्ट डीड के तौर पर दी थी।

Ref: That office e-mail dated 11-11-2024.
Kind attention is invited to the reference cited. I am furnishing herewith the detailed report called for regarding the land dispute between the Christian community and Waqf Board in the Munambam Village of Ernakulam District as appeared in the News Paper enclosed with the referred mail as follows:
First of all it is informed that the news which was attached along with the e-mail is with regard to certain speeches made by politician of a particular political party. It is submitted that the speech which is mentioned to be delivered by the politicians are without basis and is done without studying the actual facts, law and the actions taken. It is only with political intention to mislead a group of people with an intention to create problems and chaos in the society. The speech made by the respected Union Minister is defamatory to the entire Waqf Boards in the country and we are sorry to express that the speech of Hon’ble Minister is without detailed verification of the facts and is felt that it may result to create communal issues in the state.
The speech of the leaders which is reported in the news paper can be seen as made without conducting proper enquiry and without disclosing the actual facts and only for political gain by misleading poor people. To the best of knowledge of the Board in the 1902 one Abdul Sathar Haji Moosa Sait obtained registry of 404.76 acres of land on the western side of 225 links vide Purambokk Canal. Before 1900 the entire survey No.18/1 of Vadakkekara Village was unregistered Government Land and later except a 225 links vide Purambokk Canal in the middle flowing south to north the land on either side of canal was registered by Government in the name of various persons. The land which was obtained by Abdul Sathar Haji Moosa Sait in 1902 was
subsequently sold by his legal heirs to Mohammed Siddique Sait vide
document No.875/1123 Malayalam Era. Subsequently, in the year 1950 the
entire 404.76 acres which was purchased by Siddique Sait was dedicated by
him as a waqf in favour of Farook College with its managing committee. The
property was transferred in the name Farook College which had obtained
mutation Patta in favour of them with No.338. The property was lying in
north south direction in 1.5 mile long. The waqif Siddique Sait himself
manage the property for three years and at that time there was no dispute
from any corner. After handing over property completely to Farook College
disputes started in the year 1957 and several court cases were filed in this
regard. In all the cases it was found that the property belongs to the registered
holder and not any other person. From the suit filed in 1957 it can be seen that
only 19 hut dwellers were in the property. Later these illegal occupants even
raised a chappal and planted trees without any title. Subsequently, Farooq
College moved to court several times for measuring out the property but local
unauthorized occupants objected and blocked multiple attempts of Village
Officer, Police and officials. Year by year the number of illegal occupants
increased considerably and due to the various difficulties put forth by this
people the original occupant Farooq College decided to sell the property and
some of the properties were sold but still there are acres of unsold properties
which could be found out through survey. At present more than five cases are
pending before court with regard to these properties and the occupants are
trying to create law and order problem as well as communal problem in the
area without waiting for the court verdict. As far as Board is concern there is
a clear finding after due enquiry that the property covered by document
No.2113/1950 is a waqf property and is illegally occupied by persons either
through encroachment or illegal sale against the provisions of Waqf Act,
1995. Being a matter under consideration of the court the Waqf Board cannot
make unwanted comments on it and is waiting for the court verdict. Board is
not intending to grab any property from legal owners and the allegation that
malicious rumors are being spread by both sides is utter false hood as in this
matter neither the board nor any of its officers had made any public comment
with regard to this dispute. The ruling Government is making necessary
interference and is taking steps for sorting out this problem in an amicable
manner. It is understood that some persons are trying to get political gain and
arising communal allegations in this matter. The news that is reported is one sided and it can be seen that it is done with an intention to glorify a single political party. The dispute with regard to land is purely a matter that is to be
dealt by the State Government and there is no need of intervention by the
Union Government in this matter as it is the State Government which can
conduct survey, check the land records and take decision as to whether
property can be assigned to the occupiers. It is also informed that the State
Government had allowed payment of tax and the Hon’ble High Court of
Kerala had passed an order staying the order of the Government of Kerala
permitting payment of tax and the said case is pending before the Court and further actions can be taken only after disposal of the case.
There is clear legal remedy available to the persons in occupation of the land but without resorting to the legal method they in support. port of some political parties are making this as a communal issue and are submitting representations to various persons and authorities. If the occupants are confident about their title they should approach the appropriate legal forum for enforcing their right and not creating the problems in the society. It is also informed that we have not issued notice to 600 families which are residing at Munambam and the 12 enquiry which is initiated is against business persons who are residing elsewhere and we are not intented to evict poor persons from their home which is lying in a small area of land.
The Board is unaware as to how Sabarimala and Velankanni Christian shrine will become waqf property as is alleged by Shri.B.Gopala Krishnan as such an absurd statement could be explained only by the person son who had made it. Waqf Act clearly states the situations in which we can claim a property as waqf property and the comment made by Shri.B.Gopala Krishnan can be seen as one which is made without knowing the basics of law. It is seen that all the comments that are reported in the news may have hidden political agenda and also to create communal issues in the state.
